H-4 EAD Work Permit: Application and Renewal Guide

What is H-4 EAD?

The H-4 EAD (Employment Authorization Document) allows H-4 visa holders (dependents of H-1B workers) to work legally in the United States.

Who is Eligible?

H-4 dependents are eligible if the H-1B principal:

• Is the beneficiary of an approved I-140, OR
• Has been granted H-1B status beyond the 6-year limit under AC21

Application Process

Step 1: Gather Documents

• Form I-765 (Application for Employment Authorization)
• H-4 approval notice (I-797)
• H-1B spouse's approval notice
• Approved I-140 or evidence of AC21 extension
• Marriage certificate
• Passport photos

Step 2: File Form I-765

Submit the application to USCIS with the $410 filing fee.

Step 3: Biometrics Appointment

USCIS may schedule fingerprinting and biometrics.

Step 4: Receive EAD

Processing time: 3-8 months.

Renewing Your H-4 EAD

• File renewal 180 days before expiration
• Automatic 180-day extension if filed before expiration
• You cannot work if the EAD expires while renewal is pending (unless 180-day extension applies)

Important Notes

• The H-4 EAD can be revoked if the H-1B principal's status changes
• Travel outside the U.S. does not affect EAD validity
• The EAD allows work in any field, not just the H-1B spouse's field
