What is the EB-3 Green Card?

The EB-3 employment-based third preference category is for skilled workers, professionals, and other workers. It covers a broader range of occupations than EB-1 or EB-2 but typically has longer processing times.

EB-3 Subcategories

**Skilled Workers**

• Requires at least 2 years of job experience or training
• The position must require skilled labor that is not temporary or seasonal

**Professionals**

• Must hold a US bachelor's degree or a foreign equivalent
• The position must require a minimum of a bachelor's degree

**Other Workers (Unskilled)**

• For positions requiring less than 2 years of training or experience
• Limited to 10,000 visas per year (separate from the EB-3 professional/skilled cap of 40,000)
• This subcategory has the longest backlogs

The Application Process

The EB-3 process follows the same general steps as EB-2:

1. **PERM Labor Certification**: Employer must test the US labor market

2. **I-140 Petition**: Employer files with USCIS

3. **I-485 Adjustment**: File when priority date is current

4. **Green Card Approval**: Receive permanent residency

Key Differences from EB-2

• Lower educational requirements (bachelor's degree vs. master's degree)
• Less stringent experience requirements
• Generally longer processing times due to higher demand
• Priority date backlogs can be significant, especially for India-born applicants

When to Choose EB-3

• You have a bachelor's degree but not a master's degree
• Your position requires less than 5 years of progressive experience
• You don't qualify for EB-1 or EB-2
• Your employer is willing to sponsor you and you want a path to permanent residency

Important Considerations

1. **Downgrade Options**: If your priority date is current for EB-3 but not EB-2, you can file under EB-3 and later upgrade

2. **Spouse Benefits**: Your spouse can obtain an EAD (Employment Authorization Document)

3. **Portability**: After I-485 pending for 180 days, you can change employers under AC21

4. **Travel**: You can travel internationally with Advance Parole while your I-485 is pending
