What is the L-1 Visa?

The L-1 visa is a non-immigrant visa that allows multinational companies to transfer employees from their foreign offices to the United States. It is divided into two categories: L-1A for managers and executives, and L-1B for specialized knowledge workers.

L-1A: Manager or Executive

**Requirements**

• You must have worked for the qualifying organization abroad for at least 1 continuous year within the preceding 3 years
• You must be coming to the US to work in a managerial or executive capacity
• The US office must have a qualifying relationship with the foreign office (parent, subsidiary, affiliate, or branch)

**Duration**

• Initial period: 3 years (new office) or 2 years (existing office)
• Extensions: Up to 7 years total
• Blanket L-1: Available for companies with multiple qualified employees

L-1B: Specialized Knowledge

**Requirements**

• Must have worked for the qualifying organization abroad for at least 1 continuous year within the preceding 3 years
• Must possess specialized knowledge of the company's products, services, processes, or procedures
• The US office must have a qualifying relationship with the foreign office

**Duration**

• Initial period: 3 years (new office) or 2 years (existing office)
• Extensions: Up to 5 years total

Advantages of L-1 Visa

2. **No Labor Certification**: No need to prove no US workers are available

Application Process

1. **Petition Filing**: Employer files Form I-129 with USCIS

2. **Premium Processing**: Available for faster processing

3. **Consular Processing**: Apply for visa stamp at US embassy/consulate

4. **Entry to US**: Enter the US with L-1 visa stamp and approval notice

Path to Green Card

L-1 holders have a relatively straightforward path to permanent residency:

• L-1A holders can file directly under EB-1C (no PERM required)
• L-1B holders can transition to EB-2 or EB-3 categories
• Many companies sponsor Green Cards for L-1 employees as a retention strategy

Important Considerations

• The qualifying company relationship must be maintained
• You must work in the capacity stated in the petition
• If the foreign office closes, you may need to switch to another visa type
• L-1B to L-1A promotion is possible during the visa period
